New by-elections in Tlokwe

  Potchefstroom – The results of the by-elections held in seven wards of the Tlokwe Municipality on 18 September 2013 must be set aside.
This ruling by the Constitutional Court on Monday, 30 November 2015, was welcomed by the Democratic Alliance. Cllr. Hans-JurieMoolman, DA Caucus Chairperson in the Council, said in a media statement that this  means the current 29 ANC councillors will be reduced to 21 and they therefore will no longer hold the majority in the Tlokwe Municipality.
“This ruling also allows the DA to bring a motion of no confidence against the Mayor KgotsoKhumalo and Speaker BereiSegetso,” said Moolman. “This ruling proves that voting irregularities has no place in a democracy as free and fair elections are fundamental.
“The DA agrees with Judge Edwin Cameron’s belief that we cannot afford to betray those who fought so hard for a democracy: ‘Many people struggled and fought to secure the right to vote. Many lost their lives, were imprisoned or banned.’”
Willie Maphosa, Communications Manager at Tlokwe Municipality, said the
Tlokwe City Council accepts the Constitutional Court judgment. “It is clear from the judgment that the IEC had erred in the registration of voters. The court has therefore effectively set these elections aside and fresh by-elections are to be held in terms of section 25 of the Local Government: Municipal Structures Act 117 0f 1998.”
Maphosa said the judgment as of now does not have any bearing on the political management, the administration and municipal operations. “The municipality will continue with its daily work and activities and still remains committed to the smooth and quality service delivery that Tlokwe has always been renowned for.”
Thabo Mosiane, ANC Caucus Leader and Single Whip in the Council, indicated that the ruling party also accepts the judgement. “It is clear from the judgment that any irregularities, non - compliance or errors prior to or during these by – elections should be laid on the side of the IEC. No finding was made that the ANC as a political party was in any manner involved in the irregularities that formed the basis of the court’s ruling.”
He said the IEC’s system of registering voters that has been found to be inadequate. “We are ready to take on the independents or the DA anywhere and at any time. We will fight and win these by – elections. In fact we are even looking beyond the by – elections to win the coming 2016 municipal elections with a bigger margin.
“And as for the positions as far as representation of parties in the Council is concerned the ANC still holds a majority of seats at 22 seats, the DA 19, the VF+ 2 and 1 each for the Cope and an independent.”
